Praktik Sewa Lahan Pertanian di Sulawesi Selatan dalam Timbangan Hukum Ekonomi Syariah

Abstract

This study aims to analyze the practice of agricultural land leasing in Laccibunge Village, Bone Regency, South Sulawesi, and to review the practice from the perspective of Fiqh Muamalah. The research method used is qualitative with a field research type and a case study approach. Data were collected through in-depth interviews, observation, and documentation. The research findings show that the practice of land leasing in Laccibunge Village is carried out through two systems: annual leasing and leasing based on the number of harvests. In general, the pillars and conditions of the ijarah contract have been fulfilled, but there are issues regarding the certainty of harvest yields that potentially lead to gharar. Nevertheless, the community carries out this practice based on mutual trust and willingness (an-taradin). The review of sharia economic law concludes that this practice is permissible as long as it does not contain elements of mudharat and justice remains maintained for both parties.
