Implementasi Fatwa DSN-MUI No. 17 Pada Pembayaran Angsuran Pembiayaan Kepemilikan Rumah Menggunakan Akad Murabahah di Bank Syariah Indonesia Jakarta Pusat
Abstract
This study discusses the application of sanctions( Ta'zir), the suitability of sanctions (Ta'zir) with DSN-MUI fatwa No.17 / IX / 2000 concerning mampu customers who delay payments, as well as the purpose of implementing sanctions (Ta'zir) for Bank Syariah Indonesia (BSI) Center given to mampu customers but delay home ownership installment payments. The type of research used is qualitative research, with primary data obtained from interviews with Bank Syariah Indonesia Pusat. The results of this study states that: first, the provision of sanctions (Ta'zir) in the form of a warning letter from Bank Syariah Indonesia Center imposed on customers who have applied for home ownership financing in Bank Syariah Indonesia with Murabaha contract, but did not pay until maturity for 3 consecutive months from call 1-call 3. Second, in providing sanctions (Ta'zir), Bank Syariah Indonesia Pusat is guided by DSN-MUI Fatwa NO:17/DSNMUI/IX/2000 concerning sanctions on Mampu customers who delay home ownership financing installment payments using Murabaha contracts. Third, the provision of sanctions (Ta'zir) in addition to providing a deterrent effect to customers who delay payment also changes the perception of the public who consider sharia Islamic banks, because of fines such as interest in conventional banks.
