https://ejurnal.iiq.ac.id/index.php/iqtisadia <p>Iqtisadia: Jurnal Hukum Ekonomi Syariah Mahasiswa</p> Program Studi Hukum Ekonomi Syariah en-US Iqtisadia: Jurnal Hukum Ekonomi Syariah Mahasiswa https://ejurnal.iiq.ac.id/index.php/iqtisadia/article/view/3977 <p><em>This study aims to examine the practice of paying wages for funeral arrangements (tajhiz al-jana'iz) in Silungkang Tigo Village, West Sumatra, and to analyze it based on the perspective of Fiqh Ijarah. Death is a certainty that demands a fardhu kifayah obligation for living Muslims to care for the corpse. However, in the research location, the lack of community expertise has given rise to the habit of giving wages (ujrah) to those who bathe, shroud, and dig the grave. Using a qualitative field research method, data were collected through observation, in-depth interviews with traditional leaders, religious figures, and the community, as well as documentation studies. The results showed that the practice of giving wages in the form of money and rice has become a tradition ('urf) in the community based on mutual assistance. According to Islamic law, the Fiqh Ijarah analysis concludes that this practice is valid and permissible. Although the exact nominal wage requirement was not agreed upon at the beginning (not textually fulfilled), the willingness (taradhi) and the principle of mutual help (tabarru') make this contract in line with public benefit and justified in the view of the Shafi'i school.</em></p> Aulia Nurul Putri Muzayyanah Copyright (c) 2025-06-23 2025-06-23 5 1 1 13
