Abstract

The increasing number of disputes arising from default in murābaḥah financing highlights the need for legal certainty and judicial decisions that are consistent with Islamic legal principles. This study aims to examine the legal reasoning adopted by judges in resolving disputes involving default under a murābaḥah contract and to assess the appropriateness of the sharia fatwas cited in Decision Number 4418/Pdt.G/2023/PA.Tgrs of the Tigaraksa Religious Court. This research employs a qualitative method using a normative juridical and case study approach. Data were collected through the analysis of court decisions, statutory regulations, sharia fatwas, and relevant literature. The findings indicate that the court correctly determined that the defendant had committed a default by failing to fulfill the obligation to pay murābaḥah financing installments. The decision requiring the payment of the outstanding obligation, the transfer of risk over the collateralized asset, and the imposition of litigation costs was consistent with the legal consequences of default under Indonesian civil law. However, the fatwas relied upon in the court’s legal reasoning were considered less relevant than those specifically governing murābaḥah financing. The findings imply that the use of more appropriate sharia fatwa references is essential to strengthening legal certainty and ensuring the consistent application of sharia principles in the resolution of Islamic economic disputes.
