TINJAUAN FIKIH MUAMALAH TERHADAP PRAKTIK IJARAH POHON MANGGA (Studi Kasus Sewa Menyewa Pohon Mangga di Desa Tiremenggal Kecamatan Dukun Kabupaten Gresik)
Abstract
This research was carried out in the framework of providing answers to problems
that exist in the community regarding the validity of the mango tree ijarah
business, which in practice sometimes causes some people to still have doubts
about its feasibility.
The research method used in this research is a qualitative method with a type of
field research. The author carried out data collection techniques using observation,
interviews and documentation techniques.
The ijarah (rental) agreement is an alternative that is often used by people to meet
their daily needs. Among the ijarah carried out by the people of Tiremenggal
Village, Dukun District, Gresik Regency, was the ijarah of mango trees.
The results of this research conclude that: (1) The implementation of leasing
mango trees in Tiremenggal Village, Dukun District, Gresik Regency is carried
out by the owner of the mango tree coming to the tenant to rent out the mango
tree or vice versa. Mango tree rentals are carried out using an annual system. The
lease for mango trees in Tiremenggal Village, Dukun District, Gresik Regency is
carried out verbally and based on an agreement between the two parties to the
contract, namely the tenant and the owner of the mango tree, using a payment
system in full at the beginning of the contract (2) The transaction for leasing
mango trees in Tiremenggal Village, Dukun District, Gresik Regency is in
accordance with the study of muamalah jurisprudence based on the opinion of Ibnu
Qayyim al-Jauziyyah , something that evolves/develops little by little accompanied
by the legal principle/basis of the goods remaining the same as the benefits and
with the fulfillment of all the terms and conditions of the ijarah contract.
